1. Acceptance of Terms

By accessing or using SMLLR, including scanning QR codes powered by our platform or using our website at www.smllr.app, you agree to be bound by these Terms of Service.

Minimum Age: You must be at least 18 years of age to create an account or use the SMLLR platform. By accepting these Terms, you represent and warrant that you are 18 or older. If you are under 18, you must not use the service.

If you do not agree with these terms, you must not use our services.

2. Description of Service

SMLLR provides QR code generation, redirection, and analytics services that allow businesses and individuals to create QR codes, redirect users to digital destinations, and analyze engagement data.

Our platform may collect technical information such as scan events, device information, IP address, and location data to generate analytics insights.

3. Data Controller Responsibilities for QR Analytics

When you create QR codes, campaigns, or landing pages on SMLLR, you are the Data Controller for any personal data collected from individuals who scan your codes or access your links ("End Users").SMLLR processes that data solely as your Data Processor, acting on your instructions and as set out in our Data Processing Agreement.

As the Data Controller, you agree that you:

Have a lawful basis under applicable data protection law (including the Digital Personal Data Protection Act, 2023) to collect scan analytics data from your End Users before enabling analytics on any QR code or campaign.
Have provided or will provide appropriate notice to your End Users — for example, through a privacy notice on your website or physical marketing material — that scanning your QR codes may result in the collection of technical and approximate location data.
Are solely responsible for responding to data subject requests (access, correction, erasure) from your End Users regarding their scan data.SMLLR will assist you with such requests as described in the DPA.
Will not use SMLLR's analytics features to collect data from individuals in a manner that violates applicable law or your own privacy commitments to them.

Failure to comply with these obligations is a material breach of these Terms.

4. User Responsibilities

Users of SMLLR agree that they will not use the platform to:

Host or distribute illegal content.
Conduct phishing, fraud, or deceptive practices.
Distribute malware, viruses, or harmful software.
Redirect users to unsafe or malicious websites.
Violate any applicable laws or regulations.

Users are solely responsible for the content and destinations associated with the QR codes they create.

5. Platform Availability

While we strive to ensure uninterrupted service, SMLLR does not guarantee that the platform will always be available, secure, or error-free.

We may modify, suspend, or discontinue any part of the service at any time without prior notice.

6. Analytics and Data Accuracy

Analytics provided by SMLLR are intended for informational and marketing insight purposes only. While we strive to ensure accuracy, analytics data may not always be complete or perfectly precise.

7. Limitation of Liability

To the maximum extent permitted by law, SMLLR shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our platform.

This includes, but is not limited to, loss of data, business interruption, loss of revenue, or loss of profits.

8. Suspension and Termination

SMLLR reserves the right to suspend or terminate access to our services if users violate these Terms or engage in activities that may harm the platform, other users, or third parties.

Termination for convenience – If SMLLRdecides to discontinue a feature or the service, we will provide at least 30 days' prior written notice by email to your registered address, unless prohibited by law.
Termination for breach – We may suspend or terminate your account immediately and without prior notice if you engage in illegal activity, fraud, abuse of the platform, or a material breach of these Terms.
Effect of termination – Upon termination, your right to use the service ceases immediately. Your data will be handled in accordance with our Privacy Policy and Data Retention policy.

9. Third-Party Links

QR codes generated through SMLLR may redirect users to third-party websites. We do not control or endorse the content of those websites and are not responsible for their practices or policies.

10. Payments, Refunds & Cancellations

All payments on SMLLR are processed in Indian Rupees (INR) through authorised payment gateways (PayU). By completing a purchase you agree to the following terms:

Subscriptions – Plans are purchased for a fixed duration (monthly or annual) and are activated immediately upon successful payment.
No automatic renewal – SMLLR does not charge you automatically at the end of your plan period. You must manually renew.
Refund policy – Due to the nature of digital services, all sales are final and non-refundable once a plan is activated. If you believe you have been charged in error, please contact us at [email protected] within 7 days of the transaction and we will review on a case-by-case basis.
Failed payments – If a payment fails after being initiated, no amount will be deducted. If an amount is deducted but the plan is not activated, contact us and we will resolve it within 5 business days.
Plan downgrade / cancellation – You may stop using the service at any time. Your current plan will remain active until its expiry date, after which your account will automatically revert to the free tier.

11. Intellectual Property

All intellectual property rights in the SMLLR platform — including but not limited to software, design, trademarks, logos, and documentation — are and remain the exclusive property of SMLLR or its licensors.

Your content: You retain full ownership of all content you create on the platform, including QR codes, landing pages, and campaign configurations. By using SMLLR, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display your content solely to the extent necessary to provide the service to you. This licence terminates when you delete your content or close your account.

You must not copy, reproduce, reverse-engineer, or create derivative works from any part of the SMLLR platform without our prior written consent.

12. Indemnification

You agree to indemnify, defend, and hold harmless SMLLR and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your violation of these Terms of Service.
Content, URLs, or destinations associated with QR codes or landing pages you create, including any claims by third parties that such content infringes their rights.
Your failure to comply with applicable data protection laws as a Data Controller for Scan Analytics Data (see Section 3).
Your violation of any applicable law or third-party rights.

13. Marketing Communications & Opt-Out

By creating an account, you consent to receive transactional emails (account alerts, receipts, OTPs) which are necessary to deliver the service. With your separate consent, we may also send you marketing communications such as product updates and offers.

You may opt out of marketing communications at any time by:

Clicking the "Unsubscribe" link in any marketing email.
Emailing us at [email protected].

SMLLR is registered on the TRAI Distributed Ledger Technology (DLT) platform for commercial communications in compliance with the Telecom Commercial Communications Customer Preference Regulations, 2018.

14. Changes to Terms

We may update these Terms of Service from time to time. Updates will be posted on this page and the "Last Updated" date will be revised.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising from the use of our services shall be subject to the jurisdiction of the courts located in India.
